A Poynette teen faces 60 years in prison after allegedly raping a 15-year-old on Halloween night.
Gregory A. Behling, 19, Poynette, is being held in Columbia County Jail on a $7,500 cash bond after a Wednesday, Nov. 4 initial appearance in Columbia County Circuit Court. Behling is charged with felony first degree sexual assault of a child under age 16 by use of threat of force or violence.
According to the criminal complaint, Poynette Police responded to a sexual assault complaint on Nov. 1 at Divine Savior Hospital. There, the 15-year-old victim told police that on Oct. 31 she, Behling and some friends went “mudding” in Behling’s truck and then went to a birthday party.
The victim told police there was drinking going on at the party and that she also consumed alcohol stating she had difficulty maintaining her balance. A witness told police the victim was “so intoxicated that she was falling down” and needed assistance walking. Behling admitted to police that he had also been drinking.
According to the complaint, Behling and the victim left the party around 1:30 a.m. in Behling’s vehicle and drove to a friend’s apartment. The 15-year-old told police that, while in the parking lot, Behling took her pants off and had sex with her in the vehicle. The victim told police she was slapping at Behling and screamed for him to stop. She reported that Behling was pushing on her neck, making it hard to breathe, during the incident.
In the complaint, Behling told police that he and the victim “did it” and that she hadn’t shown any resistance but that she “liked it rough so he did ‘a little bit of choking’.” Police reported bruises on the victim’s body including on her back and hip. In an interview with police, Behling admitted that what he did was wrong.
According to the criminal complaint, the victim had a text conversation with Behling the afternoon of Nov. 1. The victim’s text read “What you did last night wasn’t right. That was rape.” Behling replied: “ :( sorry I feel bad”.
Behling is scheduled for a pre-trial conference in Columbia County Circuit Court on Dec. 7. He faces up to 60 years imprisonment on the felony first degree sexual assault charge.
